SECTION 20 – PAYMENT TERMS
Priya Grown Diamonds INC will charge the credit card on file within 15 days of the invoice date. If for any reason payment declined. You are agreeing to pay late fee of 0.5% each week on all the balance owed. If for any reason debt collection agency gets involve due to non payment. You as a customer will be responsible to cover all the legal cost of the collection, including lawyer fee but not limited to.
SECTION 21 – TERMS OF SALE
- The goods you receive are delivered to you for inspection and display; they remain the property of PRIYA GROWN DIAMONDS, INC. until paid for; title shall only pass to consignee when payment has been received by PRIYA GROWN DIAMONDS, INC., and such payment has cleared PRIYA GROWN DIAMONDS, bank
- A service fee of 1.5% per month (or maximum allowed by law – whichever is less) shall apply to all goods not paid for or returned beginning on the 31st day after consignee has received goods.
- If PRIYA GROWN DIAMONDS INC., has to engage the services of a collection agency or an attorney to recover money due it by consignee, consignee shall be responsible for all reasonable fees up to 35% (thirty five percent) of monies due to PRIYA GROWN DIAMONDS, INC., in addition to the money consignee owes to PRIYA GROWN DIAMONDS.
- The laws of the State of New York shall govern this agreement. The parties hereto agree that in the event litigation is commenced, consignee consents to jurisdiction in the County of New York, State of New York, or any other venue PRIYA GROWN DIAMONDS, INC. shall select.
- If any of the covenants contained herein are deemed illegal or unenforceable by a court of law (as defined in paragraph 9 above) it shall have no bearing on any of the other covenants
- This represents the entire agreement, no part of which can be changed except in writing and signed by all authorized parties.
